1. Introduction and Acceptance
These terms of use ("Terms") govern the use of services made available on or through www.bookdayly.com and the Dayly mobile applications, available on Android and iOS (together, the "Platform", and together with the services made available on or through the Platform, the "Services"). The Platform is owned, operated and made available by Dayly Household Services Private Limited, having its registered office at Eviva R, 1601, Downtown, Palava Phase 2, Dombivali-421204, Maharashtra, India ("Dayly", "Company", "we", "us" or "our"). These Terms also include any guidelines, additional or supplemental terms, policies and disclaimers made available or issued by us from time to time ("Supplemental Terms"), which form an integral part of these Terms. In the event of a conflict between these Terms and any Supplemental Terms with respect to a particular Service or subject matter, the Supplemental Terms will prevail.
These Terms constitute a binding and enforceable legal contract between Dayly and you — a user of the Services, or any legal entity that books Expert Services (defined below) on behalf of end-users ("you", "your" or "User"). By using the Services, you represent and warrant that you have full legal capacity and authority to agree to and be bound by these Terms. If you represent any other person, you confirm that you have the necessary power and authority to bind that person to these Terms. A "User" is someone who accesses or uses the Services to share, display, host, publish, transact, or upload information, views or pictures, and includes other persons jointly participating in using the Services.
By using the Services, you agree that you have read, understood, and are bound by these Terms, as amended from time to time, and that you will comply with the requirements set out here. These Terms expressly supersede any prior written agreements with you. If you do not agree to these Terms, please do not use the Services.
These Terms should be read together with Dayly's Privacy Policy, which is incorporated into these Terms by reference and describes how Dayly collects, uses and protects your personal information, including location and voice data.
2. The Services
The Services include the provision of the Platform, which enables you to arrange and schedule services with independent third-party service providers ("Experts"). As part of the Services, Dayly only facilitates (i) connecting Users with Experts onboarded to Dayly to avail the services described below, and (ii) the collection and transfer of payments to Experts for the services they render to you.
The services offered by Experts fall into two categories (together, "Expert Services"):
Housekeeping Services, which includes:
- General cleaning of the premises: sweeping, mopping, vacuuming floors, dusting, wiping furniture, shelves and other surfaces, and cleaning windows, mirrors and glass surfaces as needed;
- Dishwashing: washing and drying utensils including plates, glasses and cutlery, cleaning kitchen sinks and organising dish racks;
- Laundry assistance: washing clothes using washing machines as per the Customer's setup, and folding and arranging clean laundry;
- Bathroom cleaning: scrubbing and disinfecting toilets, sinks and showers, wiping mirrors, clearing cobwebs, and mopping bathroom floors;
- Kitchen assistance: light kitchen preparation tasks such as chopping vegetables or organising pantry items, and cleaning countertops, stoves and kitchen appliances; and
- Any other services listed on the Platform that Experts are ready to provide.
Non-Housekeeping Services, which includes:
- Packing and moving assistance;
- Business-relation assistance for solopreneurs and home businesses;
- Event-organising assistance; and
- Any other services listed on the Platform that Experts are ready to provide.
Dayly does not itself provide, and is not responsible for the provision of, any Expert Services. Experts are solely liable and responsible for the Expert Services they offer or provide through the Platform. Neither Dayly nor its affiliates employ Experts, and Experts are not agents, contractors or partners of Dayly or its affiliates and have no ability to bind or represent Dayly.
The Platform is for your personal use only, unless otherwise agreed in a separate written agreement, and is intended for use only within India. If you avail the Services or Expert Services from a jurisdiction other than India, you will be deemed to have accepted Dayly's terms and conditions applicable to that jurisdiction.
A key part of the Services is Dayly's ability to send you text messages, e-mails or WhatsApp messages, including in connection with your bookings, your use of the Services, or as part of its promotional and marketing activities. You may opt out of such messages by contacting cs@bookdayly.com, though this may affect Dayly's ability to provide the Services (or part of them) to you.
You may be required to furnish identification proof to avail the Services or Expert Services, and you agree to do so; failure to comply may result in your inability to use the Services. The Expert Services displayed on the Platform depend on Expert availability at the time of booking.
Dayly is continuously evolving to enhance the user experience. You acknowledge that the nature and scope of the Services may change, be updated, suspended, cancelled or discontinued at any time, without prior notice, including changes to service offerings, pricing, policies or platform functionality. Your continued use of the Platform following such changes constitutes acceptance of the modified terms. Dayly is not liable for any disruption, modification or discontinuation of any Service or feature, and does not guarantee that the Services will be available at all times.
3. Voice Booking
Voice Booking is an optional feature that allows you to place a booking request using your voice instead of manually selecting options on the Platform. When you choose to use this feature, the Platform records your voice only after you actively initiate recording and grant microphone permission on your device.
Your voice recording is transmitted to Dayly's servers and processed using trusted third-party cloud-based speech recognition and artificial intelligence service providers, solely to convert your speech into text and interpret your booking request. Please see Dayly's Privacy Policy for details on how voice recordings, transcripts and related data are collected, used, shared and retained.
Before your booking is confirmed, the Platform will display the interpreted booking details (such as the requested Expert Service, date and time) for your review. It is your responsibility to review and, if necessary, correct these details before confirming the booking. Dayly does not guarantee, and is not liable for, any error, delay, or additional Charges arising from a misinterpretation of your voice input by the speech recognition or AI systems used to provide this feature. If you notice an error in a voice-generated booking, please correct it on the Platform before confirming, or contact us at cs@bookdayly.com promptly after confirmation.
Voice Booking is entirely optional. You may make bookings manually on the Platform at any time without using this feature, and you may revoke microphone permission through your device settings at any time — this will disable Voice Booking only and will not affect any other feature of the Platform.
4. Account Registration and Sharing of Details
To avail the Services, you will be required to furnish certain details, including your name, e-mail address and phone number, to register and create an account ("Account") on the Platform. You must be at least 18 years of age to use the Services and share your details. Dayly reserves the right to refuse access to the Platform to new Users, or to terminate or suspend access granted to existing Users, at any time and without providing reasons.
Account Creation and User Responsibilities: To access and use the Platform, Users must register and create an Account by providing accurate, complete and up-to-date information. Dayly reserves the right to verify submitted information and approve or reject registrations at its sole discretion. You are solely responsible for maintaining the confidentiality of your Account credentials and for all activity conducted through your Account; Dayly is not liable for any loss or damage arising from unauthorised access due to your failure to secure your Account. If any information you provide is found to be false, incomplete or outdated, Dayly may suspend or terminate your Account without prior notice. You must immediately notify Dayly of any unauthorised use of, or security breach relating to, your Account.
You warrant that all information you furnish shall remain accurate and true, and you agree to promptly update it by emailing cs@bookdayly.com or updating your details on the Platform whenever it changes. You are liable and accountable for all activity that takes place through your phone or contact number, including activity by persons other than you; Dayly is not liable for unauthorised access to your phone or contact number.
You agree to receive communications from us regarding: (i) requests for payment; (ii) information about us and the Services; (iii) promotional offers and services from us and our third-party partners; and (iv) any other matter relating to the Services or your experience using them.
5. User Content
The Platform may contain interactive features that allow Users with an Account to transmit or submit reviews, suggestions, feedback, ideas or other content on or through the Platform ("User Content").
As part of the effective provision of the Services and for quality-control purposes, we may request reviews from you about Experts, and Experts may similarly provide reviews about you to us. You must not knowingly provide false, inaccurate or misleading information in any review. Reviews will be used for quality control and to determine whether Customers and Experts are appropriate Platform users; if we determine, at our sole discretion, that you are not an appropriate User, we may cancel your registration and remove you from the Platform.
You grant us a non-exclusive, worldwide, perpetual, irrevocable, transferable, sublicensable and royalty-free licence to: (i) use, publish, display, store, host, transfer, process, communicate, distribute, make available, modify, adapt, translate and create derivative works of User Content for the functioning of, and in connection with, the Services; and (ii) use User Content for the limited purposes of advertising and promoting the Services, or as evidence before a court or authority of competent jurisdiction. You waive any claims arising from moral rights or similar rights relating to User Content. Dayly may, without notice, remove or restrict access to User Content that, in its sole discretion, violates these Terms.
6. Consent to Use Data
You agree that we may use the data you share with us when registering as a User on the Platform. You consent to us sharing your information with our affiliates or other third-party service providers, and to our using information and data relating to your use of the Services for the provision of the Services, analytics, trend identification, and statistical purposes, in order to enhance the effectiveness and efficiency of the Services, and to offer beneficial schemes, new offers and an improved experience.
Subject to applicable law, we may be directed by law-enforcement agencies, the government or related bodies to disclose data relating to you in connection with criminal or civil proceedings, and you agree that we may share such data with the relevant agencies or bodies in such instances.
Our collection, use, storage and disclosure of your personal information — including location data and, where you use Voice Booking, voice data — is governed by Dayly's Privacy Policy, which is aligned with the Digital Personal Data Protection Act, 2023, the Digital Personal Data Protection Rules, 2025, and the Information Technology Act, 2000 and rules made thereunder.
7. Offers, Discounts and Free Trials
Trials, discounts or other offers ("Offers") may be introduced by the Company at its sole discretion, on terms communicated by the Company. If an Offer is provided to you, you are limited to using it once per premises (as determined by the address of the premises), unless the Offer states otherwise, and you cannot combine multiple Offers. A trial grants access to the services selected at the time of booking; features available during a trial may be limited compared to the full, paid version.
The Company may communicate with you regarding Offers and subscription plans via call, SMS, email or push notification. You are responsible for providing accurate and up-to-date information as the Company may require to provide the Services. The Company may collect and use data generated during an Offer period to analyse and improve its Services, and reserves the right to terminate or modify any trial or Offer at its discretion, without notice.
8. Bookings
Orders
The Platform lets you request Expert Services at a time of your choosing, based on available slots. To book, follow the instructions on the Platform and provide the necessary information. We use reasonable efforts to find an Expert able to provide the requested Service at the requested time; if we cannot, we will contact you to reschedule or cancel the booking.
Confirmation
Once you place a request, we will, on a best-efforts basis subject to Expert availability, allocate an Expert and provide a booking confirmation on the Platform along with the Expert's details ("Confirmation"), which may also be sent via SMS, email or push notification. Payment is required in accordance with these Terms, or as indicated on the Platform, to confirm your booking.
Cancellations
Bookings cancelled before Confirmation will not be charged. Dayly's cancellation policy sets out applicable cancellation fees, and by agreeing to these Terms, you agree to the refund and cancellation policy as well.
Substitution
If a selected Expert is unavailable or cancels, we will offer a substitute Expert from among our registered Experts on a best-efforts basis. If no Expert is available for the selected slot, we will contact you to reschedule or cancel the booking. A booking remains in effect for the duration you choose during the booking process.
Extension
You may extend a booked slot at any time before its expiry by 15 (fifteen) to 180 (one hundred and eighty) minutes, subject to: (i) the Expert's availability to continue, and (ii) the total job duration not exceeding 240 (two hundred and forty) minutes. The Company does not guarantee an extension will be available and is not liable for an Expert's refusal, inability or failure to extend a booking, whether due to technical issues, Expert availability, or any other reason, even where the Company facilitates extension requests on a best-effort basis.
Location Data
Dayly may collect and use location-based information from your device (via GPS or other technologies) when you access the Platform, to enhance, optimise and facilitate the Services. If you do not share location data, certain Platform features may not function and Dayly may be unable to deliver the Services. Dayly collects and processes location data in accordance with its Privacy Policy and applicable law.
Service-Category Corrections
If you avail Non-Housekeeping Services from an Expert when your booking was for Housekeeping Services, or vice versa, you must immediately update this on the Platform. You may incur additional Charges, including applicable taxes, for the service actually availed. Where the Expert reports that a different category of service was provided but you have not updated the Platform accordingly, the Expert's account of the service provided may be treated as correct for the purpose of calculating applicable taxes and Charges, and you will be required to pay accordingly. The Company may recover any resulting shortfall in taxes, Charges or fees separately or against your next booking.
9. Pricing, Fees and Payment Terms
Dayly reserves the right to charge you for the Expert Services you avail and any other facilities you opt for on the Platform, from time to time. In respect of Expert Services availed through the Platform, you will be required to pay:
- Expert Charges — payable by Users to Experts; the Company is only responsible for collecting these on the Expert's behalf;
- Technology Fee — payable by Users to the Company for facilitating the supply of Expert Services;
- Convenience Fee — which may be collected by the Company at its discretion for services at remote locations or requiring dedicated expertise;
- Surge Fee — which may be levied by the Company to manage demand during periods of surge; and
- Taxes — applicable taxes under prevailing law on the above charges and fees.
Dayly will notify you of applicable Charges, taxes, fees and payment methods at the time of booking. You may pay via credit card, debit card, net banking, wallets, UPI, cash, or any other method made available, in advance where applicable at the time of booking. Cash on Delivery (COD) is offered solely at the Company's discretion, including for new-customer onboarding, new-area launches, or other scenarios the Company determines. We may modify or restrict available payment modes. Certain payment methods, such as cash on completion, may be available only in specific instances at Dayly's discretion, or where you are required to pay the Expert directly for: (A) out-of-pocket expenses incurred by the Expert; and (B) expenses arising from goods necessary for, or used in, the Expert Service ("Charges").
Charges and fees may be payable at the time of booking, as specified by Dayly. For the avoidance of doubt, Charges are payable to Experts, and Dayly acts only as a limited collection agent on their behalf. Dayly may reasonably amend Charges and fees at any time at its sole discretion, including where a service is extended, a discount is applied, or a refund is issued; a change in fees will not affect bookings confirmed before the revised fees were published on the Platform.
Charges and fees you pay are final and non-refundable unless Dayly determines otherwise or applicable law requires a refund or other remedy. Decisions on cancellations and refunds rest at Dayly's sole discretion, in accordance with Dayly's internal refund policy, and are final and binding. Charges and fees may increase substantially in certain areas during periods of high demand; Dayly will use reasonable efforts to inform you of applicable Charges and fees, including surge fees and taxes, but you remain responsible for Charges incurred under your Account regardless of your awareness of them. Where you booked one category of Expert Service but availed the other, the Company may recover additional applicable taxes, charges or fees separately or against your next booking (see Section 8, Service-Category Corrections).
We may use a third-party payment processor ("Payment Processor") to bill you through your selected payment mode; processing is subject to the Payment Processor's own terms and policies in addition to these Terms, and we are not liable for any error of the Payment Processor. Unsuccessful payments will be credited back in accordance with the Payment Processor's terms. If you are redirected to a third-party payment processor, you may be subject to that party's terms and privacy policy; Dayly is not responsible for third-party practices or policies, and you are advised to review applicable terms before any transaction.
Cancellation
You may cancel your request for an Expert's services at any time before the Expert's arrival, subject to a cancellation fee under Dayly's cancellation policy; Dayly may charge or deduct applicable taxes on such fees.
Dayly reserves the right to cancel a booking where: (a) the booking has no address; (b) the booking is made by a competitor or its affiliate, as determined by Dayly in its sole opinion; (c) you call to cancel; (d) you are unreachable within 15 (fifteen) minutes of the slot, or the Expert has waited at the location for 15 (fifteen) minutes without response; (e) Dayly cannot service the booking due to supply shortages or Expert unavailability, in which case Dayly may offer a refund or reschedule at its discretion; or (f) the transaction cannot be completed for reasons outside Dayly's control.
Dayly currently facilitates on-demand, same-day and advance bookings (up to 4 (four) days in advance) for Expert Services. Dayly may, from time to time, offer packages (howsoever named) for monetary consideration, which may include benefits such as discounted Expert Services; packages are subject to additional terms and conditions that form an integral part of these Terms.
Dayly does not designate any part of your payment as a tip or gratuity to the Expert. Any suggestion by Dayly that tipping is "voluntary", "not required" or "included" does not imply that Dayly makes additional payments to Experts. You may, at your discretion, provide an additional payment as a voluntary incentive to an Expert for good service, but you are under no obligation to do so.
GST
If a Customer is registered under GST law and wishes to claim input tax credit, they must add valid and accurate GST registration details to their Account profile before placing an order. Tax invoices will be issued based on the GST details in the profile at the time of order placement, and no retrospective changes to invoices will be entertained. Dayly is not liable for any loss of input tax credit arising from non-updation, delay or inaccuracy in the Customer's GST details. The Customer declares that the GSTIN provided is true and correct and indemnifies Dayly against any liability or claim arising from incorrect GST details.
10. Customer Conduct
Dayly prohibits discrimination against Experts on the basis of race, religion, caste, national origin, disability, sexual orientation, sex, marital status, gender identity, age, or any other characteristic protected under applicable law, including refusing Expert Services on any such basis.
Please treat all Experts with courtesy and respect, and provide them a safe, clean and appropriate location, together with the necessary equipment and products, to perform the Expert Services. Experts may refuse to perform Expert Services if you fail to provide a safe, clean and appropriate location, fail to provide required accessories or equipment, provide equipment that is poorly maintained or not in working condition, or behave towards them in a discourteous, disrespectful, abusive, or otherwise inappropriate manner. We may withhold or limit your access to the Services, at our absolute discretion, if you behave inappropriately or unlawfully towards any Expert.
You will be liable for discriminating against Experts, or for any failure to provide a safe, clean and appropriate location for them to perform the Expert Services, and you must disclose to Dayly and the Expert any information bearing on the Expert's ability to perform the Expert Services safely. If an Expert behaves in a manner that is discourteous, disrespectful, abusive, inappropriate, or unlawful, you must report the incident to cs@bookdayly.com within 24 (twenty-four) hours.
You shall not, directly or indirectly, solicit, influence, engage, or encourage the solicitation of, an Expert from whom you have availed Expert Services to cease their registration with, or engagement on, the Platform, or to independently provide services similar to the Expert Services without booking through your Account. You agree this restriction is reasonable and necessary to protect the privacy and security of Experts, and that any potential harm to Experts from non-enforcement of this clause outweighs any potential harm to you from its enforcement.
11. Third-Party Services
The Platform may include services, content, documents or information owned by, licensed to, or made available by a third party ("Third Party Services"), and may link to Third Party Services. Third Party Services are the sole responsibility of the third party that created or provided them, and your use of them is solely at your own risk. We make no representations and exclude all warranties and liabilities relating to Third Party Services, including their accuracy or completeness. If you use a Third Party Service, you are bound by that third party's terms and privacy policy; all intellectual property rights in Third Party Services remain with the relevant third party.
12. Your Responsibilities
You represent and warrant that all information you provide in relation to the Services and Expert Services is complete, true and correct as of the date you agree to these Terms, and will remain so while you use the Services. You must promptly notify us of any change to that information. We accept no responsibility for loss or damage you suffer if information you provide to avail the Services is incorrect, incomplete, inaccurate or misleading, or if you fail to disclose a material fact. You agree to extend all cooperation in our defence of any proceedings arising from a breach of your obligations under these Terms.
In respect of User Content, you represent and warrant that: you own, or have obtained all necessary permissions for, the intellectual property rights needed to provide the User Content and grant the licences under these Terms; you are solely responsible for all activity on your Account and all User Content; the User Content does not violate your obligations under other agreements; the User Content does not infringe or misappropriate any intellectual property or other proprietary right, including rights of publicity or privacy; the User Content does not contain viruses, corrupted data, or other harmful files; and the User Content does not violate third-party rights, threaten India's unity, integrity, defence, security or sovereignty, incite offences, or contain material that is defamatory, obscene, harmful to children, discriminatory, hateful, violent, unlawful, or knowingly false or misleading, or otherwise violates any applicable law.
You shall not use the Services except as expressly permitted under these Terms. Without limitation, you shall not: host, display, upload, modify, publish, transmit, store or share content that belongs to another person without right, is obscene, invasive of privacy, or promotes enmity between groups; infringe any proprietary right; copy, distribute, modify, publish, reproduce or create derivative works from the Services except as permitted; transmit viruses, malware or similarly harmful code; use automated means to monitor, copy, or systematically retrieve content from the Services; use the Services unlawfully, fraudulently, or inconsistently with these Terms; decompile, reverse-engineer or disassemble the Services; impersonate any person; link to, mirror or frame any part of the Services; or otherwise violate applicable law. You shall not interfere with or disrupt the Services, or attempt to gain unauthorised access to the Services, our servers, or connected systems by hacking, password mining, or other illegitimate means.
13. Our Intellectual Property
All rights, title and interest in and to the Services, including all related intellectual property rights, are owned by or licensed to us. Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, non-sublicensable, revocable and limited licence to use the Services in accordance with these Terms and our instructions issued from time to time. Any rights not expressly granted here are reserved by Dayly or its licensors.
We may request suggestions or other feedback, including bug reports, relating to the Services ("Feedback"). We may freely use, copy, disclose, publish, display, distribute and exploit Feedback without payment, acknowledgement, prior consent, or restriction arising from your intellectual property rights. Except as expressly stated in these Terms, nothing here confers any right in, or licence to, our or any third party's intellectual property.
14. Term and Termination
These Terms remain in effect until terminated as set out here. If you object to these Terms or are dissatisfied with the Platform, you may close your Account and/or stop accessing the Platform. We may restrict, deactivate or terminate your access to the Services: (i) immediately, at our sole discretion, if you breach these Terms, are likely to fail to qualify under applicable law or our policies, or breach our guidelines; (ii) upon 7 (seven) days' prior written notice; or (iii) immediately, for any legitimate business, legal or regulatory reason.
Termination does not cancel your obligation to pay for Services or Expert Services already availed, or any other accrued or unfulfilled obligation relating to the period before termination. You remain liable for fees or charges applicable up to the date of termination. Upon termination, the Services will discontinue, and these Terms will terminate except for clauses expressly, or by implication, intended to survive termination.
15. Disclaimers and Warranties
The Services are provided on an "as is" basis, without warranty of any kind, express, implied, statutory or otherwise, including implied warranties of title, non-infringement, merchantability or fitness for a particular purpose. We do not warrant that the Services will meet your requirements or expectations, and no oral or written advice from us creates any warranty not expressly stated in these Terms. While Dayly strives to provide accurate information about Expert Services and Charges, pricing errors may occur from time to time.
You acknowledge that we are merely a Platform connecting you with Experts; we do not conduct comprehensive background verification of Experts and are not liable for any obligation not explicitly stated in these Terms. We are not responsible for the fulfilment of bookings, an Expert's performance of Expert Services, or an Expert's acts or omissions, including any damage to property. By booking Expert Services through the Platform, you enter into a contract with the relevant Expert for the provision of those services; we accept no responsibility, warranty or guarantee in respect of the Expert's performance under that contract. Soliciting or receiving services from an Expert independently of the Platform is entirely at your own risk, and doing so waives any rights you may have under these Terms. We make no representation regarding the reliability, quality or suitability of Experts, and you accept full responsibility for the consequences of your use of the Services and Expert Services.
Dayly will maintain a complaints-management framework on behalf of Experts, managed reasonably and in accordance with non-excludable requirements of applicable law. To the fullest extent permitted by law, we, our affiliates and related parties disclaim all liability for loss or damage arising from: your use of, or inability to use, or the availability or unavailability of, the Services or Expert Services; defects, interruptions or delays in the operation or transmission of information through the Services, communications failures, or unauthorised access to our records, servers or infrastructure; the Services failing to remain operational for any period; and the loss of User Content or other data in connection with your use of the Services.
In no event shall Dayly, its officers, directors, employees, contractors, agents, licensors, partners or suppliers be liable to you for any direct, special, indirect, incidental, consequential, punitive, reliance or exemplary damages (including lost business opportunities, lost revenues, lost anticipated profits, or any other pecuniary or non-pecuniary loss, including in relation to any data breach), even where advised of the possibility of such damages, arising from these Terms, the Services or Expert Services, your use or inability to use them, or interactions with another User. To the maximum extent permitted by law, our liability shall be limited to the commission we receive on the relevant booking, and our total liability to you under these Terms shall not exceed INR 10,000 (Indian Rupees Ten Thousand). Nothing in these Terms excludes or limits a warranty implied by law that cannot lawfully be excluded or limited.
16. Indemnity
You shall indemnify, defend (at our option), and hold harmless Dayly, its parent companies, subsidiaries, affiliates, and their officers, employees, directors, agents and representatives from and against any claim, demand, lawsuit, judicial proceeding, loss, liability, damage or cost (including damages, settlements and attorneys' fees) arising from your access to or use of the Services or Expert Services, your violation of these Terms, or any violation of these Terms by a third party using your Account. Your rights under this engagement are not assignable or transferable, in whole or part.
17. Jurisdiction, Governing Law and Dispute Resolution
These Terms are governed by, and construed and enforced in accordance with, the laws of India. Subject to the remainder of this clause, courts in Mumbai, Maharashtra have exclusive jurisdiction over disputes arising out of these Terms or the use of the Services.
Disputes arising out of these Terms shall be resolved by arbitration in Mumbai, Maharashtra, under the Arbitration and Conciliation Act, 1996, which is deemed incorporated by reference. The tribunal shall consist of 1 (one) arbitrator appointed by Dayly. Arbitration shall be conducted in English and kept confidential, save on a need-to-know basis or with legal advisors, or where disclosure is legally required. The arbitrator's decision is final and binding, and each party bears its own costs.

These details are provided in compliance with the Information Technology Act, 2000 and rules made thereunder, the Consumer Protection (E-Commerce) Rules, 2020, and the Digital Personal Data Protection Act, 2023. We will endeavour to resolve your grievance or complaint within the timelines prescribed under applicable law and Dayly's internal policies.

20. Miscellaneous Provisions
Changes to Terms
These Terms may be revised at any time, effective immediately upon posting. It is your responsibility to review these Terms periodically; continued use of the Platform after a change is posted constitutes acceptance of that change.
Modification to the Services
We may add, modify or discontinue the Services (or any part), temporarily or permanently, with or without cause, and are not liable for doing so.
Severability
If any provision of these Terms is found unlawful or unenforceable, the remaining provisions continue in effect; where a provision would be enforceable if part of it were deleted, that part is deemed deleted and the rest continues in effect, unless doing so would contradict the clause's clear intent, in which case the entire provision is deemed deleted.
Assignment
You may not licence, sell, transfer or assign your rights, obligations or Account under these Terms without our prior written consent, which we may grant or withhold at our discretion. We may assign our rights to any affiliate, subsidiary, parent company, successor in interest, or third party, without prior notice to you.
Third-Party Rights
No third party has any right to enforce any term of these Terms.
Force Majeure
We have no liability to you if we are prevented from, or delayed in, performing our obligations or carrying on our business by acts, events, omissions or accidents beyond our reasonable control, including strikes, utility or telecommunications failures, acts of God, war, riot, civil commotion, pandemic, malicious damage, or compliance with law or governmental direction.
21. Supplemental Terms — Multiple & Recurring Booking (“MBRB”) Facility
These supplemental terms apply exclusively to the Multiple Booking and Recurring Booking ("MBRB") Facility and are read together with the rest of these Terms and Dayly's other policies. They apply only to Housekeeping Services. In the event of a conflict between the rest of these Terms and this Section 21, this Section 21 prevails for the MBRB Facility.
Multiple Booking Facility
Dayly will facilitate multiple advance bookings (up to a number of days and slots determined by Dayly at its sole discretion) for Housekeeping Services. To place a multiple-booking order, follow the Platform's instructions and provide the required information, including your selected number of slots and days. The duration and start time of each slot will be the same across all slots booked under a single multiple-booking order.
Recurring Booking Facility
Dayly will facilitate recurring advance bookings (up to a number of days, specific days, and specific times determined by Dayly at its sole discretion) for Housekeeping Services. To place a recurring booking, follow the Platform's instructions and provide the required information, including your selected day(s) and time(s). The duration and start time of each slot will be the same across all slots booked under a single recurring-booking order.
Rescheduling, Refunds and Cancellation
Supplemental terms for rescheduling, refunds and cancellation under the MBRB Facility are set out in Dayly's refund and cancellation policy.
General Terms
Dayly may modify or withdraw the MBRB Facility, in whole or part, without prior notice, and may extend or restrict its availability to specific locations in India. Dayly is not liable for any direct, indirect, financial or non-financial liability arising from the MBRB Facility, including customer complaints or service deficiencies. Dayly will endeavour to book your preferred Expert(s) for Housekeeping Services under the MBRB Facility; where a preferred Expert is unavailable or cancels, we will offer a substitute Expert on a best-efforts basis, and such unavailability or cancellation will not, on its own, entitle you to a refund. Queries relating to the MBRB Facility should be sent to cs@bookdayly.com with the subject line "MBRB Facility"; we will make all reasonable efforts to address them, though the absence of a response is not, by itself, a deficiency on Dayly's part.
